EUR 40/70/100 compensation for debt recovery costs (B2B)

For a late B2B payment, you can claim compensation for recovery costs: EUR 40, 70 or 100, separately from interest. Check the rules.

In commercial (B2B) transactions, a creditor who has not been paid on time may claim flat-rate compensation from the debtor for debt recovery costs, separately from late-payment interest. Legal basis: the Act on Counteracting Excessive Delays in Commercial Transactions.

How much is the compensation?

  • EUR 40, where the payment does not exceed PLN 5,000,
  • EUR 70, where the payment is in the PLN 5,000–50,000 range,
  • EUR 100, where the payment is PLN 50,000 or more.

The złoty equivalent is determined using the NBP average euro exchange rate on the last working day of the month preceding the month in which payment became due.

Key rules

  • Compensation is due for each transaction (invoice) whose payment deadline has passed.
  • It is a statutory entitlement and does not need to be stipulated in the agreement beforehand.
  • It is separate from late-payment interest; you may claim both.

This provides real leverage in negotiations with the debtor. Submit your case and we will include compensation and interest in the demand and subsequent recovery action.
