How the process works
Viability assessment
Revenue, EBITDA and cash flow forecasts: we check whether the business can survive before proposing anything.
Choosing the proceedings
The four procedures differ in pace and scope of protection. A restructuring adviser makes the recommendation.
Plan and arrangement proposals
List of claims, recovery plan and arrangement terms. We compile the information on which the application will be based.
Arrangement and implementation
We coordinate document flow and communication with creditors, keeping you informed of every step.
Four types of proceedings, one goal
Polish Restructuring Law provides for four procedures. They differ in formality, pace and scope of protection against enforcement. You do not need to choose alone; in your submission, you can select “I don't know, please recommend”.
Arrangement approval
The least formal option. Creditors' votes are collected outside court; the court approves the completed arrangement.
Accelerated arrangement proceedings
For businesses with a small proportion of disputed claims. A fast route to an arrangement under court supervision.
Arrangement proceedings
Where a larger proportion of claims is disputed and a fuller procedure for establishing the list of claims is needed.
Remedial proceedings
The most extensive option. Alongside an arrangement, it allows remedial measures affecting business assets and offers the broadest protection.
The earlier you act, the more arrangement options you have
We assess for free whether your business qualifies for restructuring and which procedure makes sense. No obligation.
Plain language
Does your business have debts, but you want to keep it running?
Restructuring seeks an agreement on debt repayment and the continued operation of the business. We help prepare the information; a licensed adviser selects the appropriate proceedings.
What to prepare
- List debts, creditors and ongoing enforcement proceedings.
- Prepare information about revenue, costs and expected payments.
- Describe what would enable the business to continue operating and repay its obligations.
What happens next
We review business information and prospects for continued operation.
The adviser recommends the appropriate type of proceedings.
We help gather documents for the recovery plan and repayment proposals.
We coordinate information and documents; independent professionals perform reserved activities.
Costs and key limitations
Not every type of proceedings provides the same protection. Submitting a case alone does not stop enforcement. We do not promise creditor approval or that the business will be saved. The four types of proceedings are explained in the questions below.
Submitting a case does not mean it has been accepted for handling. Before deciding, you will receive the scope of cooperation and contract terms. See pricing and the answers below. This page is for information only and does not constitute legal advice.

Frequently asked questions
If you have not found an answer, write to us and describe what you need.
Ask a question- When can a business enter restructuring?
- Restructuring proceedings are available not only to businesses already insolvent, but also to those at risk of insolvency. There is no need to wait until payments stop; the earlier you start, the more arrangement options remain realistic.
- What types of restructuring proceedings are there?
- Four: arrangement approval proceedings (the least formal, with votes collected outside court), accelerated arrangement proceedings, arrangement proceedings and remedial proceedings, the most extensive, allowing remedial action concerning the business's assets. The choice depends on the debt structure and the protection needed. If you do not know which route to take, indicate this in the form and we will ask an adviser for a recommendation.
- Does restructuring protect against enforcement?
- Yes, but protection differs between proceedings and is broadest in remedial proceedings. This is a key factor in choosing the route, so a restructuring adviser makes a recommendation after analysing debts and ongoing proceedings.
- Who conducts restructuring proceedings?
- A licensed restructuring adviser acts as supervisor or administrator, and proceedings take place before a court. e‑PGW's role is preliminary assessment, preparation of information and documents, coordination of information flow and keeping you updated on status. Independent professionals of your choice perform reserved activities.
