Free credit sanction under Polish law

Check your credit or loan agreement

You do not have to find errors in the agreement yourself. Send it to us and our lawyers will assess for free whether it is worth going to court, your prospects and the amount you could claim.

The assessment is free and carries no obligation. We charge for case preparation through commission on the amount actually recovered*. We present our rates before we start working together.

How it works

  1. You send your agreementA PDF or photo, with no account required. Don't have the agreement at hand? Start with a short questionnaire.
  2. Our lawyers review itThey assess the agreement and payment history: whether it is worth going to court, the prospects of success and the amount you could claim.
  3. Our team prepares your caseIf you decide to proceed, we prepare the case. Our fee is a commission on the amount actually recovered, with no upfront fees.*
  4. You choose your representativeIn court, you can use our lawyers, who already know your case, or your own representative.
  5. You decide who pays the lawyer's costsUnder PozwijGo, we cover the lawyer's costs in return for higher commission. If you cover them yourself, commission is lower.

How the free credit sanction works

If the lender breaches the obligations listed in Article 45(1) of the Polish Consumer Credit Act, including requirements concerning the agreement's content and cost information, the consumer may submit a written declaration to the lender and repay the credit without interest or other credit costs payable to the lender. However, the consumer remains responsible for the costs of establishing security provided for in the agreement.

This right expires 12 months after performance of the agreement (Article 45(5)). The exact starting point is disputed in case law, so do not delay seeking advice.

In its judgment of 23 April 2026 (C-744/24) the Court of Justice of the EU held that a bank may not apply contractual interest to amounts used to cover credit costs that were not paid to the consumer. The judgment does not decide individual cases: the court determines the consequences for a specific agreement.

The legal position is not uniform, and case law continues to develop. No one can guarantee a case's outcome, so every agreement requires an individual assessment by a lawyer.

What to prepare

Agreement and attachments

All pages, including terms and amendments if you have them. Legibility matters more than format.

Repayment history

A breakdown of interest, commissions and other costs. The schedule helps distinguish amounts already paid from future payments.

Previous correspondence

Any complaint, free credit sanction declaration or lender's response, if submitted. You can still contact us without these documents.

Plain language

Do you have a credit or loan agreement?

If the lender has failed to meet statutory obligations, for example in the agreement or information about costs, you may be entitled to repay only the amount borrowed, without interest or other credit costs. Our lawyers will review your agreement free of charge.

What to prepare

  • Prepare your credit or loan agreement, including all pages and amendments.
  • If available, attach the repayment schedule and payment history.
  • Keep letters from the lender and your previous correspondence.

What happens next

  1. Submit the agreement through the form without creating an account.

  2. Our lawyers review it free of charge: whether court action is worthwhile, your prospects and the amount you may claim.

  3. If you want to proceed, our team prepares the case.

  4. You choose your court representative: our lawyer, who already knows your case, or your own.

Costs and key limitations

The assessment is free. We charge for case preparation through commission on the amount actually recovered, with rates provided before cooperation begins. There is a limited time after performance of the agreement to submit the declaration, and how this period is calculated is disputed, so do not delay. You remain responsible for the costs of securing the credit specified in the agreement. We do not guarantee the outcome.

Submitting a case does not mean it has been accepted for handling. Before deciding, you will receive the scope of cooperation and contract terms. See pricing and the answers below. This page is for information only and does not constitute legal advice.

How much in costs can you submit for review?

This is an optional overview, not a refund decision: we calculate costs only in your browser and send nothing. All fields relate to one agreement and amounts in Polish złoty.

Costs from your documents

Total interest paid, excluding the principal portion of instalments.

Only the portion already paid. If commission was financed by the loan, do not automatically enter the full amount stated in the agreement.

Exclude the commission and interest entered above; do not enter the sum of instalments.

Amounts already refunded or settled in relation to the costs entered above.

Remaining interest and costs, excluding principal; the schedule may change.

Overview for review

Enter the costs and refunds received. Enter 0 only if you know that the amount is zero.

Gross result, before any service costs. It does not confirm entitlement to the free credit sanction under Polish law or the amount of any refund due.

A lawyer will assess the agreement, payment records and deadlines. We do not add future costs and amounts already paid together as a “refund”.

Do not know the amounts? Skip the calculator: the absence of a calculation does not prevent a review of your agreement.

A short consultation is free and carries no obligation. Tell us what happened and we will make an initial assessment of your prospects and explain possible outcomes and next steps.
