How to calculate late-payment interest

How much interest can you add to an unpaid invoice? The difference between statutory interest and interest in commercial transactions (B2B), and how to calculate it.

You are entitled to interest for late payment: it is your right, rather than a ‘penalty’. The key is choosing the correct rate, because the business (B2B) rate is higher than statutory interest between private individuals.

Which interest applies to you?

  • Statutory interest for late payment, the general rule (including transactions involving consumers).
  • Interest for late payment in commercial transactions, a higher rate for amounts owed between businesses (B2B).

Rates are linked to the NBP reference rate and change periodically, so different rates may apply to different parts of the overdue period.

How to calculate the amount

The interest amount depends on three things: the debt amount, the number of days overdue and the rate for the relevant period. Instead of calculating it manually, use our interest calculator, which gives you the amount as of today.

Interest is not all

For B2B debts, you may claim flat-rate compensation for recovery costs (EUR 40/70/100) in addition to interest; we explain this in a separate article. Submit your case and we will include interest and compensation in the demand for payment.
