An unpaid invoice is one of the most common problems for small businesses in Poland. The good news: much of the debt recovery process is now automated, and you can start without paying fees upfront.
1. Demand for payment (amicable stage)
The first step is a formal demand for payment to the debtor, setting a deadline. Many cases end at this stage: a professional letter and the real prospect of court action are often enough. It is worth including accrued late-payment interest in the demand.
- Confirmation of the balance and basis of the claim (invoice, agreement, acceptance report).
- Statutory late-payment interest, which you can calculate using our interest calculator.
- For B2B transactions: compensation for recovery costs (EUR 40/70/100), see the separate article.
2. Court proceedings, e-court (EPU)
If the debtor does not respond, the case goes to court. Electronic order-for-payment proceedings (EPU, the ‘e-court’) are available for undisputed monetary claims: a fast electronic process ending with a payment order. Court representation is provided by an authorised legal representative (a Polish legal adviser or advocate).
3. Enforcement by a court enforcement officer
With a final payment order or judgment, the case goes to a court enforcement officer, who enforces against the debtor’s assets (accounts, salary, movable property and real estate).
