Electronic order-for-payment proceedings (EPU), commonly called the e-court, are designed for straightforward, undisputed monetary claims, such as unpaid invoices. The entire process is electronic, without hearings or sending paper documents.
When a case is suitable for EPU
- The claim is monetary and well documented (invoice, agreement, confirmation of performance).
- The debtor is unlikely to dispute the debt in principle.
- The claim is not time-barred; the e-court examines the due date.
What it costs
The court fee in EPU is 1.25% of the amount in dispute, one quarter of the standard 5% in ordinary proceedings. This is one of the route’s main advantages. Under PozwijGo, we may advance the fee for you and settle it only after recovery.
How the process works
- A claim is filed electronically by an authorised representative (a Polish legal adviser or advocate).
- The court issues a payment order without a hearing, usually within a few weeks.
- The debtor has 14 days to pay or lodge an objection.
- No response: the order becomes final and goes to a court enforcement officer.
What if the debtor objects?
An objection does not end the case; it causes it to be transferred to ordinary proceedings. In practice, many debtors object solely to delay matters, which is why complete documentation from the outset is so important: it is how cases are won in ordinary proceedings.
How to get started
Submit your unpaid invoice online. We will assess whether the case is suitable for EPU and prepare the documents, while an authorised representative will provide court representation. We charge on success.
